These Terms of Service ("Terms") govern your use of the Daffiliates affiliate marketing platform ("Service") operated by Daffiliates ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By registering for an account, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to use this Service. By creating an account, you represent that you meet this requirement.

3. Affiliate Program

Upon registration, your account may be subject to approval by the merchant before activation.
You will receive a unique affiliate code that serves as both a discount code and referral tracking identifier.
You agree to promote the merchant's products honestly and in compliance with applicable laws, including advertising disclosure requirements.
You must not engage in spam, misleading advertising, cookie stuffing, self-referrals, or any fraudulent activity.
You must not bid on the merchant's branded keywords in paid advertising unless explicitly authorized.

4. Commissions and Payments

Commission rates are set by the merchant per campaign and may vary.
Commissions are calculated based on qualifying orders attributed to your affiliate code or referral link.
Commissions are subject to an approval period (configured by the merchant) before becoming eligible for payout.
Commissions may be voided or adjusted if orders are cancelled, refunded, or determined to be fraudulent.
Payout requests require a minimum balance as configured by the merchant.
We are not responsible for the merchant's payment processing. Payment methods and timelines are determined by the merchant.

5. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials.
You must not share your account with others or create multiple accounts.
You must provide accurate and current information in your account profile.
You must promptly notify us of any unauthorized use of your account.

6. Prohibited Conduct

You agree not to:

Use the Service for any unlawful purpose
Attempt to manipulate tracking, attribution, or commission calculations
Interfere with or disrupt the Service or its infrastructure
Scrape, harvest, or collect data from the Service without authorization
Impersonate another person or misrepresent your affiliation

7. Termination

You may delete your account at any time through the Settings page in your portal. Account deletion permanently removes all your data, including click history, order attributions, commissions, and payout records.
The merchant may suspend or terminate your affiliate account at any time, with or without cause.
We may suspend or terminate access to the Service for violations of these Terms.
Upon termination, pending unpaid commissions may be forfeited at the merchant's discretion.

8. Data Handling

Your personal data is handled in accordance with our Privacy Policy. By using the Service, you consent to the collection and processing of data as described therein.

9. Intellectual Property

The Service and its contents, features, and functionality are owned by Daffiliates and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT OF COMMISSIONS PAID TO YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Daffiliates from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email or through the Service.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Daffiliates operates, without regard to conflict of law principles.
